1Acceptance of Terms

By accessing or using AITRAIN Academy ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

You must be at least 16 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2Service Description

AITRAIN Academy provides an online learning platform focused on artificial intelligence education, including:

• Courses and Learning Paths: Structured educational content covering AI, machine learning, and related topics
• AI Tutor: An AI-powered assistant to help with learning questions and explanations
• Assessments: Quizzes, assignments, and projects to test and apply knowledge
• Certifications: Digital certificates upon successful completion of courses
• Community Features: Discussion forums, study groups, and messaging
• Progress Tracking: Analytics and insights into your learning journey

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3User Accounts

Account Registration

To access most features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

Account Types

• Explorer (Free): Limited access to courses and features
• Builder (Paid): Full course access with standard AI tutor usage
• Pro (Paid): Premium features, unlimited AI tutor, priority support
• Team/Enterprise: Custom plans for organizations with additional management features

Account Security

You are responsible for maintaining the confidentiality of your login credentials. We recommend enabling two-factor authentication and using a strong, unique password.

4Subscriptions and Payments

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable fees.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings.

Refund Policy

• Monthly subscriptions: No refunds for partial months; cancel before the next billing cycle
• Annual subscriptions: Pro-rated refund within the first 30 days if you have not used more than 20% of course content
• One-time purchases: Refund available within 14 days if course is incomplete

Price Changes

We may change our subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing period.

Vouchers and Promotions

Promotional codes and vouchers are subject to their specific terms and conditions. They may not be combined unless explicitly stated and have no cash value.

5User Conduct and Responsibilities

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Share your account credentials or allow others to access your account
• Copy, distribute, or share course content without authorization
• Use automated systems (bots, scrapers) to access the Service
• Attempt to circumvent access restrictions or security measures
• Harass, abuse, or harm other users
• Post false, misleading, or inappropriate content
• Use the AI tutor to generate harmful, illegal, or unethical content
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity

Academic Integrity

You are expected to complete assessments honestly. Using unauthorized assistance, sharing answers, or misrepresenting your work may result in account suspension and certificate revocation.

6Intellectual Property

Our Content

All content on the platform, including courses, videos, text, graphics, logos, and software, is owned by AITRAIN Academy or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service and its content for your personal, non-commercial educational purposes. This license does not include:

• The right to resell, redistribute, or sublicense any content
• The right to download, copy, or store content except where explicitly allowed
• The right to modify, adapt, or create derivative works
• The right to use content for commercial training or educational purposes without a separate license

Your Content

You retain ownership of content you create (e.g., discussion posts, project submissions). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

Certificates

Certificates are issued for personal use. You may share certificates on professional networks and resumes. Certificates may not be sold or transferred.

7AI Tutor Usage

Nature of AI Assistance

The AI Tutor is designed to assist with learning and provide explanations. It is not a substitute for professional advice, and its responses may not always be accurate or complete.

Usage Limits

AI Tutor usage is subject to limits based on your subscription level. Excessive or abusive usage may result in temporary restrictions.

Content Guidelines

You agree not to use the AI Tutor to:

• Generate harmful, illegal, or unethical content
• Complete assignments or assessments dishonestly
• Create content that infringes on intellectual property rights
• Extract or reverse-engineer the AI model

Data Usage

Conversations with the AI Tutor may be used to improve the Service. See our Privacy Policy for details on data handling.

8Limitation of Liability

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AITRAIN ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Career outcomes or employment decisions based on our content or certifications
• Errors or inaccuracies in course content or AI responses
• Unauthorized access to your account due to your failure to secure credentials

Maximum Liability

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9Termination

Termination by You

You may cancel your subscription and delete your account at any time through your account settings. Upon cancellation:

• You retain access until the end of your current billing period
• Certificates you've earned remain valid and verifiable
• Your data will be deleted in accordance with our Privacy Policy

Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms or our community guidelines
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Abuse the Service or other users

Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

10Dispute Resolution

Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@aitrain.io to attempt to resolve any dispute informally within 30 days.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

Arbitration

Any disputes not resolved informally shall be settled by binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

11Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms with a new effective date
• Sending an email notification for significant changes
• Displaying a notice in the platform

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
